Facts of the Violations<\/strong><\/span><\/p>\n

Le Rio Cultural Space has been subjected to a series of restrictions and violations. According to its director, the institution was recently prevented from hosting several official cultural events, including the Carthage Film Festival, Carthage Theatre Days (JTC) and the Carthage Music Days, despite fulfilling all the required technical and organizational conditions. He stated that this exclusion forms part of a broader pattern of restrictions targeting the venue over the past year, directly affecting its cultural activities.<\/span><\/p>\n

The director explained that Le Rio is an open cultural venue that welcomes associations, political parties, individuals, and a wide range of civil society and cultural actors without discrimination, and that this inclusive role has been central to the institution's identity for many years. According to his testimony, the institution was deprived of the public funding allocated for its operation and management, significantly undermining its ability to meet its financial obligations, including the payment of technicians' and employees' salaries. He further reported that the institution has been subjected to administrative pressure from the Ministry of Cultural Affairs, including attempts to restrict its activities by reducing the number of approved specifications (<\/span>cahiers des charges<\/span><\/i>) governing its operations. Since these specifications determine the range of activities the institution is authorized to carry out, reducing their number would necessarily limit the scope of its permitted activities.<\/span><\/p>\n

He also stated that, in April 2025, the Public Prosecutor's Office intervened to halt a \"mock trial\" event organized jointly by the Tunisian League for Human Rights LTDH) and Beity Association.<\/span><\/p>\n

These measures form part of an ongoing pattern of administrative and financial restrictions. According to the institution, this included the cancellation of the 2025 operational and equipment grant on the grounds of alleged non-compliance with decisions issued by the General Inspectorate, despite the institution's assertion that it had never received those decisions or the related correspondence, thereby depriving it of the opportunity to review them and exercise its right to respond. The institution also reported the closure of the caf\u00e9 operating within the venue, which it considers to have directly affected its financial resources and the continuity of its activities.<\/span><\/p>\n

In addition, the institution reported attempts to exclude Le Rio Cinema-Theatre from the programming of the Carthage Theatre Days and the Carthage Film Festival, despite having hosted these events in previous editions. It further referred to an inspection visit carried out by the General Inspectorate of the Ministry of Cultural Affairs that focused on the institution's relationships with civil society organizations. The institution considers this to raise questions regarding the scope of the Inspectorate's authority over a private cultural institution. The institution's management also stated that it received a letter from the Regional Directorate of Cultural Affairs requesting that it review or reduce the number of approved specifications under which it operates. It responded by reaffirming the legality of its status and the multidisciplinary nature of its cultural activities. It further reported that payment of the 2026 operational and equipment grant was suspended even after the competent committee had approved its allocation, based on a tax classification that, according to the institution, does not accurately reflect the nature of its cultural activities or negate its identity as a theatre and cultural institution.<\/span><\/p>\n

The management of Le Rio Cinema-Theatre considers that the cumulative effect of these measures constitutes an ongoing administrative campaign that has undermined the institution's financial and administrative stability, limited its ability to continue its cultural activities and host civic and cultural initiatives, and therefore calls for access to all decisions and reports relied upon by the administration in adopting these measures, as well as the opportunity to exercise its rights of defense and appeal in accordance with legal guarantees.<\/span><\/p>\n

Human Rights Violations<\/strong><\/span><\/p>\n

The documented facts indicate the existence of a series of measures affecting the right to artistic freedom and the freedom to engage in cultural and artistic activities by a private cultural institution, raising serious concerns regarding the State's compliance with its international, regional, and domestic obligations in this field.<\/span><\/p>\n

The most significant of these measures include preventing El R\u00edo Cultural Space from hosting official cultural events despite its compliance with the required technical and organizational standards, as well as attempts to exclude it from festivals it had previously hosted. These actions constitute interference with the exercise of the rights to freedom of expression and artistic and cultural creativity, as protected by Article 19 of the Universal Declaration of Human Rights, Article 19 of the International Covenant on Civil and Political Rights (ICCPR), Article 15 of the International Covenant on Economic, Social and Cultural Rights (ICESCR), Article 9 of the African Charter on Human and Peoples' Rights, and Article 37 of the 2022 Constitution of the Republic of Tunisia. Furthermore, Article 55 of the 2022 Constitution requires that any restrictions on these rights have a clear legal basis and be necessary and proportionate to a legitimate objective, requirements that are not sufficiently demonstrated by the documented facts.<\/span><\/p>\n

The intervention of the Public Prosecutor's Office to halt the \"mock trial\" event also raises concerns regarding the impact of judicial measures on cultural and artistic activities and their compatibility with the guarantees of freedom of expression and artistic creativity protected under international and regional human rights instruments and the Constitution.<\/span><\/p>\n

The deprivation of the institution's operational public funding, and the resulting difficulties in meeting its financial obligations, particularly the payment of technicians' and employees' salaries, interferes with the right to work, guaranteed under Article 23 of the Universal Declaration of Human Rights, Article 6 of the International Covenant on Economic, Social and Cultural Rights, Article 15 of the African Charter on Human and Peoples' Rights, and Article 40 of the 2022 Constitution of the Republic of Tunisia.<\/span><\/p>\n

The suspension or withholding of public grants for 2025 and 2026, without allowing the institution access to the decisions or reports on which the administration relied or providing it with an opportunity to respond or challenge those decisions, also raises concerns regarding compliance with the guarantees of due process and the right to an effective remedy, as protected by Article 8 of the Universal Declaration of Human Rights, Article 2 of the International Covenant on Civil and Political Rights, and Article 38 of the 2022 Constitution of the Republic of Tunisia concerning the right of access to information. It further raises questions regarding respect for the principles of transparency and sound management of public funds enshrined in Article 10 of the 2022 Constitution.<\/span><\/p>\n

The reported inspection visits and the directives concerning the approved specifications (<\/span>cahiers des charges<\/span><\/i>) also raise concerns regarding the limits of administrative interference in the operation of private cultural venues and its implications for the freedom of association and the ability of associations and civil society actors to carry out their activities in open cultural spaces. These rights are guaranteed under Article 20 of the Universal Declaration of Human Rights, Article 22 of the International Covenant on Civil and Political Rights, Article 10 of the African Charter on Human and Peoples' Rights, and Article 35 of the 2022 Constitution of the Republic of Tunisia. Overall, the documented facts point to a pattern of successive administrative and financial measures targeting an independent cultural institution. Such measures risk undermining the continuity of its operations, adversely affecting the broader environment for the exercise of cultural and artistic rights, and limiting the ability of cultural and civil society actors to carry out their activities in an environment that guarantees freedom and institutional
