The case relates to a television episode broadcast more than two years ago and concerns what is publicly referred to as the \u201cconspiracy against state security case,\u201d for which a judicial decision had imposed a ban on media coverage.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">Intersection Association for Rights and Freedoms considers that prosecuting and trying a journalist and a lawyer over a televised discussion, without clearly and precisely identifying the statements alleged to constitute criminal acts, constitutes a serious violation of the principle of legality and the guarantees of a fair trial. Such practices undermine the fundamental principle that there can be no crime or punishment without a clear legal basis and open the door to vague and expansive prosecutions used to restrict freedom of opinion and expression.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">The Association further considers that this ruling forms part of a dangerous pattern marked by the widening scope of criminalization and the use of penal legislation, particularly Decree Law No. 54 of 2022, to restrict freedom of the press and expression and to target journalists and lawyers for their opinions and public statements. This approach is inconsistent with constitutional guarantees and Tunisia\u2019s international human rights obligations, notably those arising under the International Covenant on Civil and Political Rights.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">Intersection Association for Rights and Freedoms calls on all civil and political forces to mobilize against these serious and systematic violations, to stand united in defense of press freedom and freedom of opinion and expression, and to denounce trials targeting critical and opposition voices, including the prosecution of journalist Borhen Bsaies and lawyer Dalila Ben Mbarek Msaddek, as well as other opinion based prosecutions in Tunisia.
