The conviction stems from a journalistic report in which he addressed the judicial proceedings involving one of his fellow journalists.\u00a0<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">This decision is part of a broader and continuous pattern of restrictions on freedom of the press and expression in Tunisia. On 24 April 2026, the Fifth Central Unit for Combating Information and Communication Technology Crimes in El Aouina called in Zied El Heni for investigation. The Public Prosecutor&#8217;s Office subsequently ordered his detention and placement in Mornaguia Civil Prison, in a development that signals an alarming intensification of the use of criminal law mechanisms to target journalists and dissenting voices solely for exercising their legitimate right to freedom of expression and press.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">Intersection association for Rights and Freedoms expresses its full solidarity with journalist Zied El Heni and his family, considering this decision as part of a new systematic policy that\u2019s based on police and judicial harassment, targeting journalists for their work duties and their media content. This prosecution also falls within a broader context of restrictions that have affected some journalists, human rights defenders, and opinion holders in recent times.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">The association also recalls that journalist Zied El Heni has been previously judicially prosecuted and subjected to prison sentences due to media statements and opinions expressed in the context of his journalistic work. This reflects the authorities\u2019 persistence in adopting a punitive approach rather than respecting the constitutional and legal guarantees related to freedom of expression and freedom of the press, both of which are protected under the Tunisian Constitution and the International Covenant on Civil and Political Rights, particularly Article 19.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">The association also condemns the authorities\u2019 reliance on vaguely worded penal provisions, foremost among them Article 86 of the Telecommunications Code, in a clear circumvention of the legal framework governing the journalism profession, particularly the provisions of Decree-Law No. 115 of 2011 on Freedom of the Press, Printing, and Publishing. And it\u2019s important to note that this decree-law is supposed to constitute the primary and exclusive legal reference for addressing cases related to publication and journalistic work.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">Intersection Association for Rights and Freedoms expresses that the prosecution of journalists before criminal courts and the imposition of custodial sentences against them constitute a grave violation of freedom of opinion, expression, and the press. It further holds that such measures are inconsistent with Tunisia\u2019s international obligations to protect rights and freedoms, including the right of access to information and the freedom to exchange opinions and ideas without fear of prosecution or punishment.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">In conclusion, the Association calls for the immediate and unconditional release of journalist Zied El Heni and for the termination of all judicial proceedings based on journalistic work or the peaceful expression of opinion. The Association also reiterates its unequivocal opposition to all forms of the criminalization of journalism and the use of the judiciary as a tool to silence dissent and intimidate independent voices.
