In this context, the Association recalls the fundamental principles enshrined in the Universal Declaration of Human Rights, which must not be undermined under any circumstances. Article 3 guarantees every person\u2019s right to life, liberty, and security of person, while Article 5 prohibits torture and cruel, inhuman, or degrading treatment or punishment. Article 25 further affirms the right of every person to an adequate standard of living ensuring health and well-being.<\/p>\n
The Association emphasizes that these rights and guarantees are not diminished by deprivation of liberty and do not disappear once a person enters prison. The State remains legally obligated to respect, protect, and ensure the enjoyment of these rights, as they are inherent to human dignity.<\/p>\n
Similarly, the United Nations Standard Minimum Rules for the Treatment of Prisoners (the Nelson Mandela Rules) translate these general obligations into detailed standards. Rule 1 provides that all prisoners must be treated with respect due to their inherent dignity and protected from all forms of cruel, inhuman, or degrading treatment. Rule 5 further states that prison conditions should, as far as possible, minimize differences between life in prison and life in the community.<\/p>\n
Rule 13 requires that all prisoner accommodation, particularly sleeping quarters, meet health requirements while taking climate conditions into account, including air volume, minimum floor space, lighting, heating, and ventilation.<\/p>\n
Rules 25 and 26 require the provision of clean and accessible sanitary facilities whenever necessary, as well as bathing facilities and hygiene measures appropriate to climatic conditions. Rule 27 requires prompt access to medical care in urgent cases, while Rule 33 requires medical professionals to report to prison authorities any situation in which a prisoner\u2019s health is negatively affected by conditions of detention.<\/p>\n
Intersection for Rights and Freedoms stresses the need to comply with international standards guaranteeing the rights of prisoners. Under the current circumstances, Tunisian prisons require increased field monitoring, direct and regular assessment of prisoners\u2019 actual health conditions, and greater access for independent oversight bodies, human rights organizations, and specialized medical authorities to inspect detention conditions. This includes assessing the availability of water and ventilation, measures taken to address power outages, and the monitoring of critical health cases, in order to ensure transparency and prevent the deterioration of health or humanitarian risks inside prisons beyond civilian oversight.<\/p>\n
The Association further reiterates its call for effective policies to reduce prison overcrowding, which remains one of the main challenges affecting respect for human dignity and the right to health, particularly under exceptional climatic conditions. It also calls for enhanced protection for vulnerable groups of prisoners, including older persons, individuals with illnesses and chronic conditions, and persons with disabilities, as they are more exposed to health complications that may threaten their lives amid the combined effects of overcrowding and extreme temperatures.<\/p>\n
Respect for the rights of persons deprived of liberty is not a privilege granted to them; rather, it is a constitutional, legal, and ethical obligation incumbent upon the State and a key measure of its commitment to human rights and the rule of law.<\/p>\n
In conclusion, Intersection for Rights and Freedoms affirms that protecting the rights of persons deprived of liberty is not an administrative choice or a temporary measure adopted when needed, but a legal and moral obligation borne by the State and its institutions. The Association calls on all civil society actors to strengthen monitoring, documentation, and advocacy efforts and to continue observing respect for fundamental guarantees within places of detention.<\/p>\n
