{"id":6773,"date":"2026-07-31T15:43:09","date_gmt":"2026-07-31T14:43:09","guid":{"rendered":"https:\/\/intersection.uno\/?p=6773"},"modified":"2026-08-03T15:45:48","modified_gmt":"2026-08-03T14:45:48","slug":"skander-sassi-victim-of-ill-treatment-and-torture-during-detention","status":"publish","type":"post","link":"https:\/\/intersection.uno\/en\/skander-sassi-victim-of-ill-treatment-and-torture-during-detention\/","title":{"rendered":"Skander Sassi: Victim of Ill-Treatment and Torture During Detention"},"content":{"rendered":"<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">Intersection Association for Rights and Freedoms expresses its deep concern over allegations of torture and ill-treatment suffered by citizen <strong>Skander Sassi<\/strong>, aged 33, during his detention at the <strong>Civil Prison in Kasserine<\/strong> in connection with a criminal case.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">It should be noted that the victim holds a disability card confirming that he has an intellectual disability and receives regular psychological follow-up. He has also previously been admitted on several occasions to Razi Hospital in Manouba. This places him in a vulnerable situation requiring special protection and care in accordance with national legislation and relevant international standards.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">According to information documented by the association, based on testimonies from the victim\u2019s family, Skander Sassi was placed in solitary confinement (\u201cthe cell\u201d) as a disciplinary measure without any justification being provided. He was then transferred to the Civil Prison in Sidi Bouzid without prior notification to his family. He was also prevented from appearing before the court at his first hearing, reportedly due to a breakdown involving the prisoner transport vehicle belonging to Sidi Bouzid Prison.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">The family further reported that, during one of their visits, they observed clear signs of violence on Skander\u2019s body, raising serious suspicions that he had been subjected to torture or other forms of ill-treatment while in detention. Following this, the family filed a complaint with the Sentence Enforcement Judge at the Court of First Instance in Kasserine. The judge reviewed the initial information, ordered that Iskander be brought in for inquiries into the alleged incidents, requested verification and examination of the injuries, and ordered the opening of an investigation into the circumstances of the alleged assault.<\/span><\/p>\n<p style=\"direction: ltr;\">According to the victim\u2019s family, Iskander appeared before the court at the following hearing, where it was decided that he would be released. However, after his release, he was surprised to learn that several prison officers had filed a criminal complaint against him, accusing him of assault, threats, and defamation committed against them while they were carrying out their duties.<\/p>\n<p style=\"direction: ltr;\">Intersection Association for Rights and Freedoms considers that the documented facts, combined with the victim\u2019s vulnerable health and psychological condition, raise serious concerns regarding respect for his right to physical and psychological integrity, as well as the guarantees owed to detained people, particularly persons with disabilities, who must be provided with protection, care, and reasonable accommodations consistent with national laws and international standards.<\/p>\n<p style=\"direction: ltr;\">Article 25 of the 2022 Constitution of the Tunisian Republic prohibits torture and all forms of cruel, inhuman, or degrading treatment or punishment, and guarantees the inviolability of the body and human dignity. Article 36 provides that every person deprived of liberty has the right to humane treatment that preserves their dignity, while Article 54 requires the State to protect persons with disabilities and take measures to guarantee their rights and inclusion.<\/p>\n<p style=\"direction: ltr;\">Article 7 of the International Covenant on Civil and Political Rights also prohibits torture and other cruel, inhuman, or degrading treatment or punishment, while Article 10 requires that all persons deprived of their liberty be treated humanely and with respect for their inherent dignity. The Convention against Torture obliges States to conduct prompt and impartial investigations into all credible allegations of torture or ill-treatment. The Convention on the Rights of Persons with Disabilities requires protection against violence and abuse and the provision of reasonable accommodations and appropriate safeguards during detention.<\/p>\n<p style=\"direction: ltr;\">Rule 45 of the United Nations Standard Minimum Rules for the Treatment of Prisoners (the Nelson Mandela Rules) further confirms that solitary confinement should only be used as an exceptional measure and prohibits its use where, due to a person\u2019s intellectual or psychosocial disability, it would worsen their condition or suffering.<\/p>\n<p style=\"direction: ltr;\">In light of these facts, the Association considers that what Iskander Sassi allegedly experienced requires a rapid, independent, and effective investigation into the allegations of torture and ill-treatment, ensuring accountability for anyone found responsible, while providing all necessary legal guarantees to the victim and taking into account his status as a person with an intellectual disability in all relevant judicial and administrative procedures.<\/p>\n<p style=\"direction: ltr;\">Intersection Association for Rights and Freedoms calls on the Tunisian authorities to:<\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">-Ensure an independent, effective, and impartial investigation into all allegations of torture and ill-treatment suffered by Skander Sassi, publish its findings, and hold accountable anyone proven responsible in accordance with the law.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">-Ensure the victim\u2019s protection from any acts of retaliation, intimidation, or pressure related to his exercise of the right to report violations or cooperate with judicial authorities.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">-Guarantee respect for the victim\u2019s procedural rights, while taking into account his health condition, psychological situation, and intellectual disability, and provide the necessary reasonable accommodations and support throughout all stages of the proceedings.<\/span><\/p>\n<p style=\"direction: ltr;\"><span style=\"font-weight: 400;\">-Ensure respect for the rights of all detained persons, particularly persons with disabilities, in accordance with the Tunisian Constitution and Tunisia\u2019s international obligations, and adopt measures necessary to prevent torture and ill-treatment in places of detention.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Intersection
