Intersection Association for Rights and Freedoms expresses its deep concern over allegations of torture and ill-treatment suffered by citizen Farouk Amroussia on 17 August 2026. These allegations raise serious concerns regarding the continued use of violence and ill-treatment in places of detention and warrant the immediate opening of an independent, impartial, and effective judicial investigation to establish the facts, determine responsibility, and hold accountable anyone found to be involved.<\/span><\/p>\n

According to the information available, Farouk Amroussia was taken on 17 August 2026 to the security station in Kalaa Sghira following a dispute between two passengers aboard a public transport vehicle, in which the victim was not involved. He was subsequently transferred to the Sousse National Security District. According to his testimony, he was subjected to violence there, primarily because of his previous affiliation with a student organization.<\/span><\/p>\n

The victim reports having been subjected to physical and psychological torture, including severe beatings to his legs and mouth, having bottles of urine poured over him inside a detention room filled with broken glass, as well as being sprayed with incapacitating gas and assaulted while detainees were incited against him.<\/span><\/p>\n

The information available also indicates that the victim was denied access to his medication despite suffering from a chronic illness. His family was not informed of his situation until 48 hours later, after which he was transferred from the Sousse National Security District to Mornaguia Prison. On 21 August 2026, the victim appeared before the court, which sentenced him to a financial fine.<\/span><\/p>\n

In this context, the Intersection Association for Rights and Freedoms condemns the acts allegedly committed against Farouk Amroussia, which, if substantiated, would constitute serious violations of his right to physical and psychological integrity and of the absolute prohibition of torture and other cruel, inhuman, or degrading treatment or punishment. They would also constitute a violation of his right to healthcare and access to medication.<\/span><\/p>\n

The Association stresses that these allegations require a serious and independent investigation capable of establishing the circumstances surrounding the incidents and determining responsibility, rather than limiting the inquiry to their immediate physical consequences.<\/span><\/p>\n

The Association further notes that Article 101 bis of the Tunisian Penal Code does not only criminalize torture, but also covers acts of humiliation, insult, intimidation, and incitement to violence. Article 103 of the Penal Code establishes individual criminal responsibility for anyone who directly commits, participates in, orders, or incites such acts. In this regard, the Association stresses the need to apply these provisions to anyone found responsible for the acts under investigation, without exception.<\/span><\/p>\n

IARF also condemns the victim\u2019s deprivation of his right to healthcare and access to medication and stresses that persons deprived of their liberty retain their fundamental rights, including the right to receive necessary healthcare, in accordance with the relevant legal safeguards.<\/span><\/p>\n

Accordingly, Intersection Association for Rights and Freedoms calls for:<\/span><\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0-The immediate opening of a judicial investigation that is independent, impartial, and effective into all circumstances surrounding the allegations of torture and ill-treatment suffered by Farouk Amroussia, with responsibility established and anyone found to have been involved held accountable, whether through direct involvement, participation, ordering, or incitement, in accordance with the findings of the investigation.<\/span><\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0-Ensuring that the victim has access to an independent and appropriate medical examination documenting the injuries and harm he sustained.<\/span><\/p>\n
