احداث الانتهاك:

 

محسن الزياني شاب تونسي اصيل منطقة سبيبة بولاية الڨصرين، كان متواجدا في تونس العاصمة بسبب عمله كبائع متجول. يوم 8 سبتمبر 2022 قامت دورية تابعة للحرس الديواني بمداهمة أحد الشوارع المحاذية لساحة الحبيب ثامر بعد تفطنها لوجود كمية من السجائر المهربة بإحدى السيارات التابعة للتجار هناك. واثناء المداهمة وقعت مواجهات بين اعوان الديوانة و التجار هناك من بينهم محسن الزياني ضحية الانتهاك حيث تم إصابته بإحدى الرصاصات التي اطلقها عون الديوانة التونسية، بعد ذلك غادرت سيارات الديوانة المكان، وبقي محسن ينزف مرميا على الارض والناس من حوله يتصلون بالإسعاف لتحمله على وجه السرعة إلى المستشفى. وبعد ان تم نقل محسن إلى المستشفى الاستعجالي بشارل نيكول والتأكد من خبر وفتاه بعد ساعات من وصوله إلى المستشفى. وقامت الديوانة التونسية بتنزيل بيان توضيحي حيث انكرت تعمد العون الذي أطلق الرصاص واصاب محسن الذي كان داخل السيارة وحاول الفرار بها حسب البيان الذي ورد به ” ممّا أجبر أحد زملائه على إطلاق أعيرة نارية تحذيرية في الهواء وعلى عجلات السيارة أصابت إحداها السائق ” في حين اكدت بعض الصور التي تم تناقلها عبر وسائل الاعلام وصفحات التواصل الاجتماعي وجود اثار الرصاص على البلور الامامي والجانبي للسيارة لتنفي صحة الرواية التي تناقلتها الجهات الرسمية.

 

انتهاكات حقوق الانسان:

تعتبر وفاة محسن الزياني انتهاكا للحق في الحياة الذي تضمنته المادة 3 من الإعلان العالمي لحقوق الإنسان، علاوة على هذا فإن استعمال الرصاص في وجه مواطن اعزل هو خرق لمبدأ الضرورة والتناسب والذي يفرض التدرج في استعمال القوى. خاصة وانه في مثل هذه الحالة الضحية كان اعزلا ولا يحمل بيده اي سلاح يمكن ان يشكل خطرا على اعوان الحرس الديواني.

On September 8, 2022, a customs patrol raised one of the streets adjacent to Habib Thameur Square after discovering a quantity of smuggled cigarettes in one of the vehicles belonging to one of the traders there. During the raid, clashes broke out between customs officers and traders, including Mohsen Zayani, who was consequently shot by a Tunsian customs officer. Subsequently, customs vehicles left the scene, leaving Mohsen bleeding on the ground, while people around him called for an ambulance to take him to the hospital quickly. After Mohsen was transferred to the emergency hospital at Charles Nicolle and his death was confirmed hours after his arrival, the Tunisian customs authority issued a clearing statement. In the statement, they denied that the officer who fired the shot deliberately hit Mohsen, who was inside the car and reportedly attempted to flee it. According to the statement, the officer’s actions forced one of his colleagues to fire shots into the air and at the car’s wheels, with one of the shots hitting the driver. However, some photos that went viral on social media and news outlets showed bullet holes in the car’s front and side windows, which is incompatible with the narrative of the official authorities.

Human Rights Violations:

The death of Mohsen Zayani is a violation of the right to life guaranteed under Article 3 of the Universal Declaration of Human Rights. Moreover, the use of live ammunition against unarmed citizens is a transgression of principles of necessity and proportionality, which require a graduated use of force.
