 أروى بركات صحفية تونسية وناشطة نسوية. مساء يوم 17 سبتمبر الماضي كانت أروى عائده إلى منزلها مع صديقاتها، حيث أوقفتهم دورية شرطة بعد دقائق من بدء حظر التجول. وبعد الانتهاء من توقيع محضر الغرامة الخاص بخرق حظر التجول. قامت الصحفية بتوثيق وتصوير تواجد سيارات أخرى في الطريق وعدم قيام دورية الشرطة بإيقافها أو بتحرير محاضر مخالفات ضدها. ليقوم أعوان الشرطة بتعنيفها واحتجازها. حيث قام أحدهم باقتحام سيارتها والاعتداء عليها بالعنف وافتك هاتفها الجوّال لمنعها من التصوير أو الاتصال بمحامي. ومن ثم تم نقلها إلى مركز الشرطة بحي الخضراء أين التحق بها المحامي لتقوم بإيداع شكاية ضد عون الأمن المعتدي ويتم سماعها كمتضررة إلا أنها وجدت نفسها أثناء التحقيق في موقف المتهمة بـ ” الاعتداء بالعنف الشديد على عون أمن أثناء مباشرته لمهامّه”. وتم عرضها في الخامسة صباحا من نفس اليوم في حالة إيقاف أمام مساعد وكيل الجمهورية كمشتكى بها من طرف عون الأمن.

المحاكمة والإجراءات القانونية:

تم عرض أروى على المحكمة الابتدائية بباب بنات بتونس العاصمة يوم الثلاثاء 21 سبتمبر الماضي، حيث تم سماعها من قبل وكيل الجمهورية مما مكنها من الإدلاء بشهادتها ردا على الاتهامات الموجهة ضدها. وقرر وكيل الجمهورية بتونس العاصمة إرجاع ملف أروى لاستكمال البحث في مكان محايد بمقر الحرس الوطني في باردو وفي الخميس 30 سبتمبر أصدر وكيل الجمهورية إخلاء سبيل احتياطياً لصالح أروى بركات إلى غاية تعيين موعد جلسة قادمة. وأصدرت المحكمة أيضًا أمرًا بجلسة استماع أخرى يوم 22 أكتوبر 2021، حيث ستواجه أروي اتهامات “الاعتداء بالعنف الشديد على موظف اثناء اداء مهامه”. إلا أنه لم يتم النظر في شكوى العنف التي قدمتها أروى ضد عون الأمن في 22 سبتمبر 2021 من المكتب الذي قدمت فيه. وقد تم تأجيل قضية الناشطة اروى بركات إلى تاريخ 18 جانفي 2023.

انتهاكات حقوق الإنسان: اعتداء عون الشرطة على الصحفية أروى بركات يمثل انتهاكا صارخا للحرمة الجسدية ولحقوق الإنسان عامة إضافة إلى أن عدم الأخذ بشكاية أروى بركات في مركز الشرطة يعتبر انتهاكا للحق في المحاكمة العادلة والحق في التقاضي الذي ضمنته المواثيق المحلية والأعراف الدولية.

After completing the process of signing the fine for violating the curfew, the journalist documented and filmed the presence of other cars on the road, which were not stopped or fined by the police patrol. Consequently, the police officers proceeded to assault and detain her. One of them plunged into the car, violently attacked her, and confiscated her phone to prevent her from taking pictures or contacting a lawyer. She was then taken to the police station in Khadra District, where her lawyer joined her to file a complaint against the assaulting officer. However, during the investigation, she found herself charged with “severely assaulting an officer while he was performing his duties.” At 5 AM on the same day, she appeared for detention before the assistant public prosecutor, as she was accused by the police officer.

Trial Procedures:

Arwa was presented before the Court of First Instance at Bab Bnet in Tunis on Tuesday, September 21st, 2021. During the session, she was heard by the public prosecutor, allowing her to provide her testimony in response to the accusations against her. The public prosecutor in Tunis decided to refer Arwa’s case for further investigation and release her until a future court session is scheduled. The court also issued an order for another hearing on October 22, 2021, where Arwa will face charges regarding the complaint about “severely assaulting an employee during the performance of his duties.” However, the complaint that Arwa filed against the police officer on September 22, 2021, from the office where she submitted it, has not been considered. The case of Activist Arwa Barket has been postponed to January 18, 2023.
