أحداث الانتهاك:

في تاريخ 29 جويلية 2021 قامت السلطات الأمنية التونسية بوضع القاضي المعزول ووكيل الجمهورية الأسبق بشير العكرمي قيد الإقامة الجبرية، بعد اتهامه بالتستر على ملفات متعلقة بالإرهاب وتعطيل التحقيق فيها، والتلاعب بملفات قضائية .وتم رفع هذه العقوبة في 10 أكتوبر 2021.

وفي 12 فيفري 2023 قامت قوات الشرطة بمداهمة منزل بشير العكرمي مع تفتيشه وحجزه حاسوبه الشخصي وهاتفه، ثم اقتياده إلى مقر وحدة مكافحة الإرهاب ببوشوشة، حيث تم التحقيق معه لمدة فاقت 24 ساعة بموجب شكوى تقدم بها ضده أعضاء في فرقة مكافحة الإرهاب ببشوشة في العاصمة، وذلك فيما يعرف بملف العملية الإرهابية في متحف باردو سنة 2015.

وفي تاريخ 17 فيفري رفضت النيابة التمديد في الاحتفاظ به مع إطلاق سراحه. إلا انه تم في نفس اليوم إصدار قرار من النيابة العمومية يقضي بوجوب إيداع بشير العكرمي بمصحة الأمراض العقلية بناء على تقرير طبي لم يتم تمكين هيئة الدفاع من الاطلاع عليه كما تم منع الزيارة عن بشير العكرمي في الأيام الأولى من إيوائه داخل المستشفى. وحسب شهادة ابن ضحية الانتهاك لجمعية تقاطع صرح أنه أثناء مقابلة والده مع بقية أفراد عائلته في المستشفى أكد أنه لم يكن على علم حتى بإطلاق سراحه وتم نقله إلى المستشفى دون تقديم أي معلومات. وحسب ما جاء على لسان ابن ضحية الانتهاك أنه أثناء مقابلة والده مع بقية أفراد عائلته في المستشفى أكد أن والده لم يكن يعلم بقرار إطلاق سراحه وأن إيواءه في المستشفى كان دون تقديم أي معلومات أو توضيح في الغرض. في حين أكد رئيس الهيئة الوطنية للوقاية من التعذيب فتحي الجراي في تصريح لإذاعة أن بشير العكرمي يتلقى العناية الطبية اللازمة وأن حالته مستقرة وهو واعٍ بما يحدث من حوله وفي 10 مارس 2023 تم إيداع بشير العكرمي في السجن بناءً على بطاقة إيداع جديدة في حقه. حيث انه تقرر فتح بحث تحقيقي في حقه وهو مودع في السجن إلى غاية هذا الشهر دون أي تطورات جديدة في قضيته. ومنذ ذلك التاريخ لايزال بشير العكرمي يقضي مدة تفوق التسعة أشهر داخل أسوار السجن دون أي تطورات في القضية التي سجن على إثرها. وتعتبر عائلته وهيئة الدفاع عنه أنه محتجز تعسفيا وأن سجنه غير قانوني.

 

انتهاكات حقوق الإنسان:

يعد احتجاز بشير العكرمي انتهاكا صارخا لحقوق الإنسان وتعديا على الحق في المحاكمة العادلة حيث إنه من غير العادل احتجاز مواطن بمصحة للأمراض العقلية قسرا ودون علمه رغم إطلاق سراحه، وإيداعه بالسجن مرة أخرى لمدة تقارب الشهر دون التحقيق معه. إذ يعد هذا الاحتجاز نابعا عن قرار سياسي وتشفيا من بشير العكرمي بعد أن تم عزله سابقا بقرار رئاسي، كما يمثل انتهاكا للمادة السابعة من الميثاق ‏العالمي لحقوق الإنسان والتي جاء فيها ” الناس جميعا سواء أمام القانون، وهم يتساوون في حق التمتع بحماية القانون دونما تمييز، ‏كما يتساوون في حق التمتع بالحماية من أي تمييز ينتهك هذا الإعلان ومن أي تحريض على مثل هذا التمييز. كما يعد تجاوزا ‏للمادة التاسعة من نفس الإعلان والتي نصت على انه ” لا يجوز اعتقال أي إنسان أو حجزه أو نفيه تعسفاً”.‏

On July 29, 2021, Tunisian security authorities placed Bachir Akremi, a dismissed judge and former prosecutor, under house arrest. On February 12, 2023, police forces raided and searched Bachir Akremi’s residence and seized his personal computer and mobile phone. He was subsequently taken to the Bouchoucha Unit for Combating Terrorism Headquarters, where he was interrogated for more than 24 hours following a complaint filed against him by members of the Bouchoucha counter-terrorism unit concerning the 2015 terrorist attack at the Bardo Museum.

On February 17, 2023, the prosecution refused to extend his detention and ordered his release. However, on the same day, the public prosecution issued a decision ordering Bachir Akremi’s placement in a psychiatric hospital based on a medical report that his defense team was not permitted to access. He was also denied family visits during the first days of his stay at the hospital.

According to testimony provided by the victim’s son to Intersection Association, during a family visit to the hospital, Bachir Akremi was reportedly not informed that he had been released or provided with any explanation regarding his transfer to the hospital.

Meanwhile, Fathi Jarray, President of the National Body for the Prevention of Torture, stated to a radio station that Bachir Akremi was receiving the necessary medical care, that his condition was stable, and that he was aware of what was happening around him.

On March 10, 2023, Bachir Akremi was imprisoned pursuant to a new arrest warrant issued in connection with another case. Since then, his family and defense team have considered his detention to be arbitrary and unlawful, particularly in the absence of developments in the proceedings underlying his imprisonment.

Human Rights Violations

The circumstances surrounding Bachir Akremi’s detention raise serious concerns regarding the right to liberty, protection against arbitrary detention, and the right to a fair trial.

His forced placement in a psychiatric hospital following a decision to release him, without his alleged knowledge or access to the medical report on which the decision was based, raises concerns regarding procedural safeguards and his right to information and defense. His subsequent imprisonment under a new arrest warrant has also been considered by his family and defense team to constitute arbitrary and unlawful detention.
