279 يوما مرت على اعتقال السياسي عبد الحميد الجلاصي على ذمة القضية التي عرفت إعلاميا بقضية التآمر، حيث تم إيداعه في السجن المدني بالمرناڨية منذ ذلك التاريخ دون أي جديد في قضيتهم، سواء من الاستماع إليهم أو كشف أدلة جديدة تجعلهم محل إدانة. هذا وأن الحالة الصحية لعبد الحميد الجلاصي تطلب رعاية صحية خاصة كونه كان مصابا بمرض السرطان ويستحق متابعة دورية. إلا أنه في الأونة الأخيرة أحس بأوجاع تسببت في تعكر حالته الصحية وحسب شهادة ابنته لجمعية تقاطع من أجل الحقوق والحريات، صرحت ابنة ضحية الانتهاك أن والدها تم نقله في الأسبوع الأخير أكثر من ثلاث مرات من قبل إدارة السجن إلى المستشفى ليتلقى العلاج اللازم. وفي اتصالها الأخير مع المحامين يوم الثلاثاء 15 أوت 2023 أخبروها أنه تم نقل والدها للمستشفى للكشف عن حالته الصحية. كما أضافت أن الظروف السجنية ساهمت في سوء الحالة الصحية لعبد الحميد الجلاصي حيث إنه يتقاسم الزنزانة مع نزلاء مدخنين في حين أن وضعيته الصحية لا تتحمل ذلك وأن التدخين السلبي كذلك يعتبرا بالأمر الخطر بالسنة لرجل في عقده السادس لا زال حديث التعافي من مرض السرطان. هذا وأن كل القوانين المتعلقة بأماكن الاحتجاز تنص على ضرورة حماية المساجين وتوفير جميع الظروف الملائمة لهم.

انتهاكات حقوق الإنسان:

إن سجن الأشخاص على خلفية نشاطهم السياسي يعد انتهاكا لحقهم في حرية التعبير وحرية التنظم والعمل السياسي، علاوة على أن مدة سجن عند الحميد الجلاصي قاربت الستة أشهر وهي مدة الاحتفاظ الأولى التي من المرجح التمديد فيها، إلا أن كل هذا الوقت قد مرّ دون أي تطورات جديدة في القضية أو ورود إثباتات جديدة تدين المتهمين، ولا حتى صدور أي حكم يقضي بإدانتهم ما يعبر عن انتهاك صارخ للحق في المحاكمة العادلة. إلى جانب هذا تعد الحالة الصحية لعبد الحميد الجلاصي من الحالات التي تطلب متابعة دورية وظروف خاصة حيث إن تواجده مع أشخاص مدخنين في نفس الزنزانة يعرضه إلى الخطر ويساهم في سوء حالته الصحية، هذا وأن للسجين الحق في العناية الإنسانية إذ من المفترض التعامل مع المحتجزين بإنسانية واحترام لكرامتهم، وأن يتم تلبية احتياجاتهم الأساسية. علاوة على الحق في الوصول إلى الرعاية الصحية، حيث يحتّم على السلطات توفير رعاية صحية ملائمة وفعالة للمحتجزين، بما في ذلك فحص دوري وعلاج للأمراض والإصابات. وهو ما يجب على السجون التونسية التقيد به وضمانه لكل المساجين على قدم من المساواة.

It has been 279 days since Politician Abdelhamid Jlassi was arrested in connection with the case known in the media as the conspiracy case. He has been since then detained in the Civil Prison of Mornaguia without any updates on the case, whether it is about questioning or disclosing new evidence that would indict him. It is worth mentioning that the health of Abdelhamid Jlassi necessitates exceptional healthcare as he used to have cancer and needs regular monitoring. However, lately, he has experienced pain, which led to the deterioration of his health. In a testimony to Intersection Association for Rights and Freedoms, the victim’s daughter stated in the last week, the prison’s administration took her father to the hospital to receive the required treatment more than three times. On 15th August 2023, on the last call with the lawyers, she was told that her father was transferred to the hospital for a check-up. She also added that the prison conditions contributed to the decline in Abdelhamid’s health, as he shared the cell with inmates who smoke, while his state does not support that because passive smoking is hazardous for someone in his 60s and who has recently recovered from cancer. More than that, laws related to places of detention mandate the necessity to protect prisoners and offer them adequate conditions

Imprisoning individuals because of their political activity violates their right to freedom of expression, assembly, and political activism. In addition, Abdelhamid Jlassi’s imprisonment has reached nearly six months, which is the initial detention period and is likely to be extended. All this time, nonetheless, has passed without any new progress in the case or emergence of new evidence condemning the accused, and no verdict has been issued to sentence them, which is a flagrant transgression of their right to a fair trial. Furthermore, Abdelhamid Jlassi’s health state requires regular monitoring and special condition, as living in the same cell with smokers expose him to danger and weakens his state. Besides, prisoners have the right to humane treatment, where it is required to treat them with humanity, respect their dignity, and meet their essential needs. Authorities must offer adequate and effective health care for prisoners, including regular medical examinations and treatment of diseases and injuries.
