مساء يوم الأربعاء 22 فيفري 2023، قامت قوات الشرطة بإلقاء القبض على السياسي والأمين العام للحزب الجمهوري التونسي عصام الشابي،حيث تم إيقافه من طرف أعوان الوحدة الوطنية الأولى للبحث في جرائم الإرهاب والجرائم الماسة بسلامة التراب الوطني عندما كان بسيارته الخاصة رفقة زوجته، وذلك بعد أن تمت مداهمة منزله وتفتيشه وحجز عدد من الأغراض الشخصية لضحية الانتهاك، إذ لم يكن بحوزة أعوان الوحدة الوطنية الأولى للبحث في جرائم الإرهاب والجرائم الماسة بسلامة التراب الوطني أي إذن قضائي يخولهم للاحتفاظ به. ويأتي إيقاف السياسي والقيادي بالحزب الجمهوري التونسي عصام الشابي في علاقة بالأبحاث المتعلقة بشبهات في الانتماء لتنظيم إرهابي والتآمر على أمن الدولة الداخلي والخارجي والتحريض على قلب نظام الحكم. وفي ساعات متأخرة من نفس اليوم تم استنطاق ضحية الانتهاك طبقا لإذن من وكيل الجمهورية بالقطب القضائي لمكافحة الإرهاب. حيث تم سؤاله عن نشاطه السياسي وعلاقاته بعدد من النشطاء السياسيين المعارضين لمسار 25
جويلية 2021. وبتاريخ 25 فيفري 2023 قام قاضي بالقطب القضائي لمكافحة الإرهاب بإصدار بطاقة إيداع بالسجن في حق السياسي عصام الشابي، ليظل معتقلا بالسجن المدني بالمرناڨية حتى هذا اليوم.

يأتي اعتقال عصام الشابي في ظل حملة يشنها النظام التونسي ضد عدد من المعارضين لمسار 25 جويلية، إذ أن اعتقال سياسي تونسي في ظروف غامضة واعتباره إرهابي على خلفية نشاطه السياسي ومعارضته للسلطة يعد انتهاكا للحقوق المدنية والسياسية حيث نص العهد الدولي للحقوق المدنية في المادة التاسعة عشر فقرة أولى والتي تنص على أنه لكل إنسان حق في اعتناق آراء دون
مضايقة. علاوة على هذا إن اعتماد قانون الإرهاب كمطية للتشفي من المعارضين السياسيين يعد ضربا واضحا لدولة القانون والمساواة ولا يعتبر إلا تراجعا من مفهوم سيادة القانون وتكريسا لنظام قمعي عبر توظيف أجهزة الدولة بهدف تصفية الخصوم
السياسيين. إذ يعتبر الحق في المعارضة السياسية من الحقوق الأساسية والمهمة في الديمقراطيات الحديثة، حيث يتيح هذا الحق للأفراد والمجموعات التعبير عن رأيهم ومواقفهم حول القضايا السياسية المختلفة، والتعبير عن رفضهم للسياسات والقرارات
الحكومية التي يرونها غير ملائمة أو غير عادلة. كما يشمل هذا الحق أيضًا الحق في التظاهر والاحتجاج والاجتماع والتنظيم،والتواصل مع وسائل الإعلام لتعزيز ونشر الرسالة المعارضة. ويحمي القانون هذا الحق ويكفل للمعارضين السياسيين الحماية من التعرض لأي أذى أو تهديد أو اضطهاد من قبل الحكومة أو أي شخص آخر.

On Wednesday evening, February 22, 2023, police forces arrested the Politician and Secretary-General of the Tunisian Republican Party, Issam Chebbi. He was arrested by The First National Unit for Combatting Terrorism and Organized Crime Affecting National Security State officers when he was with his wife in his car. That was after raiding and inspecting the violation victim’s place of residence and seizing several personal belongings without any warrant that mandated holding him in custody. Arresting the Politician and Leader of the Tunisian Republican Party, Issam Chebbi, is related to investigations into suspicions of affiliation with a terrorist organization and conspiring against the internal and external Security State, as well as inciting the overthrowing of the ruling regime. Later on the same day, the victim of this violation was interrogated by virtue of a warrant issued by the Public Prosecutor of the Judicial Counter-Terrorism Pole. The arrest of Issam Chebbi is part of a campaign launched by the Tunisian regime against several opponents of the Course of 25 July. The detention of the Tunisian politician in mysterious circumstances and labeling him as a terrorist based on his political activities and opposition to the authorities is a transgression of civil and political rights. The International Covenant on Civil and Political Rights in Article 19, Paragraph 1 states that “Everyone has the right to hold opinions without interference.” Moreover, enacting terrorism laws as a tool to target political opponents is a clear violation of the principles of the rule of law and equality.
