أحداث الانتهاك:
في يوم 31 جانفي 2023، قامت قوات الشرطة بإيقاف الناشط النقابي صلب الإتحاد العام التونسي للشغل، الكاتب العام للنقابة الخصوصية تونس للطرقات السيارة ” أنيس الكعبي ”. على خلفية شكاية تقدمت بها الإدارة العامة لشركة تونس للطرقات السيارة، اتهم فيها أنيس الكعبي بالتسبب في خسائر مادية للشركة. وذلك إثر تصريحاته حول الإضراب القطاعي المقرر من قبل نقابة الطرقات السيارة يومي 30 و31 جانفي الفارط. في إطار مطالبتهم بتجديد اتفاقية لزمة استغلال الطريق السيارة ”أ1 حمام الأنف مساكن”. ولم تكتف السلطات بإيقاف أنيس الكعب، حيث قام رئيس الجمهورية ” قيس سعيد ” مساء يوم 31 جانفي 2023 بتصريح أدلى به من داخل مقر ثكنة الحرس الوطني بالعوينة قال فيه ” إن الحق النقابي مضمون بالدستور لكن لا يمكن أن يتحول إلى غطاء لمآرب سياسيّة لم تعد تخفى على أحد” حسب تعبيره. كما شبه هذا الإضراب بمثابة عملية قطع الطرق أو التهديد بذلك. كما توعد كل من يقوم بذلك بأنه من غير الممكن أن يبقى خارج دائرة المساءلة، وفق ما جاء على لسانه. وفي بلاغ توضيحي للمحكمة الابتدائية صادر عن مكتب الإعلام والاتصال يوم 01 فيفري 2023، أقرت أنّه تمّ تعهيد الإدارة الفرعية للقضايا الإجرامية التابعة لإدارة الشرطة العدلية بالبحث في موضوع شكايتين تقدّم بها الممثل القانوني لشركة تونس للطرقات السيارة ضد أحد موظفي الشركة، وأنّه تم الاحتفاظ بالسيد أنيس الكعبي بعد سماعه ومواصلة البحث. موضحين أن الشكاية التي وردت في حق أنيس الكعبي كانت بتاريخ 30 جانفي الماضي، مفادها تعمد أحد موظفي الشركة استغلال صفته، والتدخل في برامج إذاعية وإعلان أن أعوان محطات الاستخلاص بالطريق السيارة سيتولون الدخول في إضراب، ورفع الحواجز بجميع المحطات للسماح للسيارات بالمرور دون دفع المعاليم المستوجبة، في اطار التصعيد في صورة عدم الاستجابة لمطالبهم، ودعوة مستعملي الطريق السريعة المرور مجانا.
ويوم 02 فيفري 2022 تم إيداع أنيس الكعبي في السجن بعد إصدار قاضي التحقيق بالمحكمة الابتدائية بتونس بطاقة إيداع بالسجن في حقه.
المحاكمة:
تم إيقاف السيد أنيس الكعبي يوم 31 جانفي 2023 من قبل فرقة مقاومة الإجرام بالڨرجاني وإحالته على التحقيق على خلفية شكاية تقدمت بها الإدارة العامة لشركة تونس للطرقات السيارة. حيث يمثل أنيس الكعبي كمتهم في جريمة استغلال موظّف عمومي لصفته، قصد الإضرار بالإدارة والإعتصاب المتقاررعليه، قصد تعطيل خدمة عمومية وذلك بالاستعفاء جملة من الخدمة طبق أحكام الفصلين 96 و107 من المجلة الجزائيّة. ثم في 02 فيفري 2023 قام قاضي التحقيق بالمحكمة الابتدائية بتونس بإصدار بطاقة إيداع بالسجن في حقه.
انتهاكات حقوق الإنسان:
يعد إيقاف السيد أنيس الكعبي انتهاكا لحقه في حرية العمل النقابي والذي يلازمه الحق في الإضراب، كما يعد خطاب التصعيد والوعيد الذي ألقاه رئيس الجمهورية تهديدا واضحا لحق التونسيين والتونسيات في الإضراب والدفاع عن حقوقهم.ن الاقتصادية والاجتماعية وضربا مباشرا لحرية العمل النقابي. الذي يحميه العهد الدولي الخاص بالحقوق المدنية والسياسية. والذي يكفل الحق في الحرية النقابية إذ تنص المادة 22 فقرة أولى على حق كل فرد “في حرية تكوين الجمعيات مع آخرين، بما في ذلك حق إنشاء النقابات والانضمام إليها من أجل حماية مصالحه. علاوة على ذلك إقرار منظمة العمل الدولية حق العمال في الإضراب وتأكيدها على جميع الدول الأعضاء والتي تعد الدولة التونسية إحداهن، ضرورة تنفيذ واحترام حقوق العمال. ناهيك على دستورية الحق في الإضراب حيث نص دستور الجمهورية التونسية في الفصل الحادي والأربعون الذي يكفل الحق النقابي للشعب التونسي إذ جاء فيه” الحقّ النّقابي بما في ذلك حق الإضراب مضمون.’‘.

The authorities did not only arrest Anis Kaabi, as on the evening of January 31, 2023, in the National Guard Barracks Headquarters in L’Aouina, President Kais Saied stated that “Trade union rights are guaranteed by the constitution, but they cannot be turned into a cover for political ambitions that are no longer hidden from anyone,” according to him. He also compared this strike to a form of road blockade or the threat thereof. He warned that anyone engaging in such actions would not escape accountability, as stated by him. In a clarifying statement issued by the Court of First Instance through the Office of Media and Communications on February 1, 2023, It was confirmed that the Sub-Directorate of Criminal Affairs, affiliated with the Judicial Police Department, had been tasked with investigating two complaints filed by the legal representative of Tunisian Highway Company against one the company’s employees and that Anis Kaabi was detained following his interrogation, and the investigation is going. It was further noted that the complaint against Anis dates back to the 30th of January, and it alleged that one of the company’s employees deliberately exploited his position and announced on radio programs that the payment toll booth operators would go on strike. He also mentioned raising the barriers at all toll stations to allow vehicles to pass without paying the required fees as part of the escalation if their demands were not met and called on highway users to pass for free.

On 31, January 2022, Anis Kaabi was arrested by the Unit for Combating Crime of Al-Gorjani to be later referred for interrogation due to a complaint filed against him by the General Administration of Highway Tunisia Company. In addition, the escalation and intimidating speech of President Kais Saied is clearly a threat to Tunisian citizens’ right to strike and defend their economic and social rights, as well as a blatant violation of freedom of union activity. They are rights guaranteed by the International Covenant on Civil and Political Rights, which ensures the right to freedom of association. It stipulates in Article 22, Paragraph 1 that: ”Everyone shall have the right to freedom of association with others, including the right to form and join trade unions for the protection of his interests. Moreover, the International Organization of Labor affirms the right of workers to strike and emphasizes this to all member states, including Tunisia. Furthermore, the constitutionality of the right to strike is established, as the Tunisian Constitution in Article 41 guarantees trade union rights to Tunisian people, stating: “Trade union rights, including the right to strike, are protected.”
