أحداث الانتهاك:

على إثر تصريحات الأستاذ العياشي الهمامي حول وضعية عدد من القضاة الذين تم إعفاؤهم طبقا لقرار رئيس الجمهورية حيث عبر انه أن تمت إحالة 16 قاضيًا على قطب مكافحة الإرهاب منذ شهر أوت وسبتمبر من سنة 2022، وذلك إثر صدور أحكام المحكمة الإدارية بإيقاف تنفيذ قرار العزل في حقهم. حيث عبّر لنا الأستاذ العياشي الهمامي أن إحالته على القضاء كانت بسبب تصريحه لإذاعة شمس فم الذي ندد فيه بعزل عدد من القضاة والتشهير بهم في الرائد الرسمي للجمهورية التونسية. إضافة إلى تصريحه حول نية المجلس الأعلى المؤقت للقضاء رفع الحصانة عن 13 قاضيا ليتمكن قاضي التحقيق بقطب مكافحة الإرهاب من سماعهم. وعلى إثر ذلك علم الأستاذ العياشي الهمامي بأنه محل تتبع قضائي حيث تمت إحالته على التحقيق أمام أنظار قاضي التحقيق بالمكتب الثاني بالمحكمة الابتدائية بتونس بسبب شكاية تقدمت بها وزيرة العدل الحالية، حيث وجهت له تهم من قبيل تعمد استعمال شبكات وأنظمة اتصال لترويج ونشر إشاعات كاذبة بهدف الاعتداء على حقوق الغير والإضرار بالأمن العام ونسبة أمور غير حقيقة بهدف التشهير بالغير وتشويه سمعته طبقا لما جاء بالفصل 24 من مرسوم عدد 54 لسنة 2022 مؤرخ في 13 سبتمبر 2022 يتعلق بمكافحة الجرائم المتصلة بأنظمة المعلومات والاتصال. وفي شهادته لجميعة تقاطع قال الأستاذ العياشي الهمامي، أن ملف القضية يتضمن العديد من الاختلالات علاوة على سرعة الإجراءات غير المعتادة في سير القضاء التونسي حيث إن مراسلة الوزيرة للوكيل العام الذي بدوره نظر في الملف وإحالة الى وكيل الجمهورية ثم إلى قاضي التحقيق ثم إعلام فرع المحامين بوجود قضية متعلقة بشخصي تمت في غضون ساعات من الزمن.  ما يؤكد سعي السطلة لملاحقة كل من ينتقدها ومحاكمته بهدف تكميم الأفواه والتشفي منه.

 

انتهاكات حقوق الإنسان: ‏

أن ما صرح به الأستاذ العياشي الهمامي هو من ‏قبيل ممارسته لحقه في حرية التعبير حيث إن مثل هذه المحاكمات التي ‏تسلط على النشطاء الحقوقيين بسبب تصريحاتهم وأراءهم في قضايا تهم الرأي العام هي من قبيل الممارسات القمعية التي تهدف إلى انتهاك حرية الرأي والتعبير، علاوة على يمثله نص الإحالة المتمثل في الفصل 24 من المرسوم 54 من قمع لحرية التعبير وترهيب للنشطاء بهدف تكميم أفواههم و إثنائهم عن الخوض في القضايا التي تهم الشأن العام وانتقاد أجهزة الدولة، إن مقاضاة الأشخاص بسبب آرائهم يعد مخالفة صريحة  للمادة 19 من ‏الإعلان العالمي لحقوق الإنسان والذي نصت على انه ” لكل شخص الحق في حرية الرأي والتعبير، ويشمل هذا الحق حريته في ‏اعتناق الآراء دون مضايقة، وفي التماس وتلقي ونقل المعلومات والأفكار من خلال أي وسيلة إعلامية ودونما اعتبار للحدود.” ناهيك على جملة الانتهاكات التي يتضمنها المرسوم عدد 54 بوضع عقوبات سجنية وغرامات مالية مجحفة لعدد واسع من الجرائم ذكرها المرسوم بصفة غامضة وفضفاضة دون الأخذ بعين الاعتبار المضار التي يمكن أن تترتب عنها. كما إن مضاعفة العقاب في حالة تعلق القضية بموظفي الدولة يعطي حصانة غير مشروعة للموظفين العموميين والمسؤولين في أجهزة الدولة، في حين إن هؤلاء هم أول أشخاص عرضة للانتقاد في إطار ممارستهم لعملهم والذي بدوره يعتبر من صميم الشأن العام. وهذا ما يفسر توجه الدولة التونسية نحو المزيد من التضييق على حرية التعبير ومنظومة الحقوق والحريات.

:Incidents of Violation

Following Attorney Ayach Hammams’s statements regarding the situation of several dismissed judges in accordance with the President’s decisions, in which he announced that 16 judges were referred to the Counter-Terrorism Pole between August and September 2022, pursuant to the issuance of the Administrative Court rulings to suspend the enforcement of their dismissal decisions. Ayachi Hammami expressed that referring him to the judiciary was due to his statement on Shams FM, in which he condemned the dismissal of several judges and defaming them in the Official Gazette of the Tunisian Republic, in addition to his statement about the intention of the Temporary Supreme Judicial Council to lift immunity on 13 judges so that the investigating judge at the Counter-Terrorism Unit can hear their statements. Following that, Attorney Ayachi Hammami learned that he was subject to a judicial investigation, which led to his referral for interrogation before the investigating judge at the Second Office of the Court of First Instance in Tunis due to a complaint by the current Minister of Justice. He was accused of the deliberate use of communication channels and systems to spread and disseminate false rumors with the aim of violating other individuals’ rights and attributing false matters with the purpose of defaming and smearing their reputation, according to Article 24 of Decree No.54 of the year 2022, dated September 13, 2022, related to combating crimes associated with the information and communication systems. In his testimony to Intersection Association, Attorney Ayachi Hammami stated that there are several irregularities within the case, in addition to the unusually rapid procedures in the Tunisian judicial process. He mentioned the Minister’s correspondence with the Attorney General, who reviewed the case and referred it to the Public Prosecutor and then to the investigating judge, followed by informing the Lawyer’s Branch of a case related to his person within hours. This indicates that the authorities’ pursuit of anyone who criticizes them and emphasizes their adherence to silence and retaliate against them

:Human Rights Violations

Attorney Ayachi Hammai’s statements fall under his right to exercise freedom of speech. Certainly, trials targeting right activists due to their statements and opinions regarding cases related to public affairs are part of the oppressive policies that seek to violate freedom of expression. Moreover, the referral text under Article 24 of Decree No.54 represents a suppression of freedom of expression and intimidates activists with the aim of silencing them and discouraging them from engaging in public affairs cases and criticizing state institutions, as suing people because of their opinions is a clear violation of Article 19 of the Universal Declaration of Human Rights which stipulates: “Everyone has the right to freedom of thought and expression. This right includes the freedom to hold opinions without interference and to seek, receive, and impart information and ideas through any media and regardless of frontiers.” Not to mention the number of violations within Decree No.54, which imposes imprisonment and hefty fines for a large number of crimes mentioned vaguely and loosely therein, without taking into consideration the fallout it may result in. Furthermore, doubling punishment in cases involving state employees gives unjustified immunity to public servants and officials in government institutions, for they are the first people to be subjected to criticism in the conduct of their missions, which is an important part of public affairs. This explains the measures taken by the Tunisian State in order to suppress freedom of expression and rights and freedoms systems
