يمثل الاعتداء على بدر بعبو انتهاكا للحق في الحرمة الجسدية، والذي يعد من أبرز حقوق الانسان الأساسية التي كفلها دستور الجمهورية التونسية صلب الفصل 23 الذي نصّ على ان «الدولة تحمي كرامة الذات البشرية وحرمة الجسد وتمنع التعذيب المعنوي والمادي ولا تسقط جريمة التعذيب بالتقادم»، كما كرستها مختلف الاتفاقيات الدولية. وخاصة الاعلان العالمي لحقوق الانسان (ضمن الفصل 5) والعهد الدولي للحقوق المدنية والسياسية في إطار الفصل 7 والذي تضمّن انه لا يجوز اخضاع أحد للتعذيب ولا للمعاملة او العقوبة القاسية او اللاإنسانية او الحاطّة من الكرامة..
