يوم 31 مارس من سنة 2018 كان عمر متواجدا بالملعب الاولمبي برادس لتشجيع ناديه المفضل في مباراة كرة قدم. بعد ذلك وقعت بمدارج الملعب مواجهات بين الجماهير الرياضية وقوات الشرطة لتنتقل إلى خارج اسوار الملعب ويتم على إثرها ملاحقة عدد من الجماهير الحاضرة يومها، من بينهم الشاب عمر العبيدي الذي ركض ناحية واد مليان وقفز فيه خوفا من القبض عليه وتعنيفه من قبل الامنيين، وبقي يتخبط وسط المياه الموحلة طالبا النجدة، ليطل عليه أحد الشرطيين الذي رفض إنجاده وهو يصارع الموت ويقول له حسب رواية اصدقائه المتواجدين هناك. ” تعلم عوم”. ليتوفى عمر في نفس اليوم وتبقى قضيته مفتوحة بعد مرور 4 سنوات دون محاسبة او محاكمة للجناة الذين لا يزالوا في حالة سراح.

الإجراءات القضائية:

منذ وفاة ضحية الانتهاك عمر العبير إلى حين اخر جلسة بتاريخ 13 جانفي 2022، شهد ملف القضية عدة خروقات اولها تكييف القضية على انها قتل غير عمد وعدم انجاد شخص في حالة خطر. في حين ان هيئة الدفاع اقرت بأن كل القرائن الموجودة تفيد ان ما حدث لعمر العبيدي هو من افعال القتل العمد. ففي 4 ديسمبر 2021 قامت الدائرة الجناحية بالمحكمة الابتدائية ببن عروس بإحالة 14 شرطيا لمحاكمتهم بنفس التهم المذكورة اعلاه. ثم تم تأجيل القضية إلى غاية 13 جانفي 2022 ليتم تأجيلها إلى 31 مارس 2022 لتتزامن مع الذكرى الرابعة لوفاة عمر، الا انه ومع إضراب الجهاز القضائي تم تأجيل الجلسة إلى تاريخ اخر.حيث قررت الدائرة الجناحية بالمحكمة الابتدائية ببن عروس، تأجيل النظر في قضية وفاة محب النادي الإفريقي عمر العبيدي، إلى جلسة يوم 20 أكتوبر 2022. التي تم على إثرها استنطاق 14 متهما في جلسة سرية ثم حكمت الدائرة الجناحية بالمحكمة الابتدائية ببن عروس بسجن 12 أمنيا و عدم سماع الدولة في حق أمنين أخرين يوم الخميس 3 نوفمبر 2022 لتنتقل في ما بعد إجراءات التقاضي إلى الطورالاستئنافي إثر طعن لجنة دفاع ضحية الانتهاك في الحكم الابتدائي أين قضت الدائرة الجناحية لدى محكمة الاستئناف بتونس بتأخير النظر في القضية الى يوم 8 ديسمبر 2023 .

انتهاكات حقوق الإنسان:

تمثل حالة عمر العبيدي انتهاكا صارخا لحقوق الإنسان. ففي مرحلة اولى تم انتهاك حرية التجمع السلمي وذلك من خلال ضرب الجماهير الرياضية والاعتداء عليها، علاوة على هذا فلقد تم انتهاك الحق في الحياة للشاب عمر العبيدي، مع هضم حقه من خلال إطالة إجراءات التقاضي وإفلات الجناة من العقاب

In contrast, the defense team asserted that all the existing evidence suggests that what happened to Omar Labidi was intentional homicide. In December 2021, the Criminal Department of the Court of First Instance in Ben Arous referred 14 police officers to trial on the abovementioned charges. However, the case was postponed to March 31, 2022, to coincide with the fourth anniversary of Omar’s death. Due to the strike of the judicial sector, the session was rescheduled again to a later date. The Criminal Department of the Court of First Instance in Ben Arous postponed reconsidering the case of the Club African’s fan, Omar Labidi, to October 20, 2022.
