” لكل إنسان حق في حرية التعبير. ويشمل هذا الحق حريته في التماس مختلف ضروب المعلومات والأفكار وتلقيها ونقلها إلى آخرين دونما اعتبار للحدود، سواء على شكل مكتوب أو مطبوع أو في قالب فني أو بأية وسيلة أخرى يختارها.”

Oussama Farhat, a Tunisian national and primary school teacher, was subjected to criminal prosecution after posting a critical comment on the official page of his academic institution. His comment addressed the institution’s policies concerning the provision of psychological support services for students. This peaceful expression resulted in prolonged criminal proceedings under Article 86 of the Telecommunications Code, repeated security and administrative summonses, and significant professional and psychological harm. The case constitutes a clear interference with his right to freedom of opinion and expression.
Mohamed Khallouli, a Tunisian human rights defender, was sentenced to one month of imprisonment and fined 1,000 Tunisian dinars following Facebook posts published on his personal account. The posts included satirical criticism of the then Head of Government, Ahmed Hachani, the Minister of Agriculture, and the President of the Republic, as well as a post condemning police violence.
Khaled Mabrouki, originally from Bizerte Governorate, was a 32-year-old man suffering from psychological disorders. He was arrested and detained at Borj Erroumi Prison following a dispute with one of his neighbors. During his detention, he was subjected to medical neglect and ill-treatment and was not provided with the necessary healthcare for his mental condition. After his release from prison, his psychological condition deteriorated, and he later died by suicide. 
Hatem Abed, a 25-year-old Tunisian man from Hammam Lif, was arrested on April 11, 2025, in connection with a penal case and later detained at Mornaguia Civil Prison. He died under suspicious circumstances inside the prison. According to his father, his death is suspected to have resulted from torture and ill-treatment. Despite several judicial and administrative attempts by his family to uncover the circumstances of his death and hold those responsible accountable, these efforts have not resulted in any effective investigation or serious accountability, which reinforces the suspicious nature of his death in detention.
At the beginning of December 2025, following multiple cases of suffocation affecting students at Gabès City Preparatory School due to emissions from the Gabès Chemical Group, environmental activist Islem Zrelli went to the site of the incident to film and document the event. According to his account, this was done at the request of the families of the affected students. He documented the incident through a live broadcast on his Facebook page, where he regularly publishes content related to the environmental crisis in Gabès. Zrelli reported that only one and a half minutes after starting the live broadcast, he was approached by a plainclothes police officer who demanded that he stop filming and immediately end the live stream. He added that the officer attempted to seize his phone without providing any explanation. When the officer tried to forcibly take the phone, Zrelli refused to hand it over and was subsequently threatened with arrest. The officer warned him that his actions would expose him to legal prosecution, justifying this threat by claiming that filming inside educational institutions was prohibited. During this time, Zrelli attempted to contact a family member or a friend to inform them of what was happening to him, but the police officer forcibly prevented him from making any phone call. Instead, the officer called for a police patrol, which arrived at the scene, arrested Zrelli, and forcibly took him to the police station, in a clear violation of his right to communicate with his family and inform them of his situation.
Nabil Maallaoui, a Tunisian national from the governorate of Nabeul, was arrested in January 2025 without any judicial ruling having been issued against him and was placed in detention at the Belli Civil Prison in Nabeul. During his detention, Maallaoui developed cancer while in prison. However, he did not receive the necessary medical care. Prison authorities reportedly limited their response to providing him with “pills” and an injection, without ensuring any serious or continuous medical follow-up. According to testimony from his sister, his health condition deteriorated day after day amid severe overcrowding in the cell where he was held and deprivation of adequate nutrition. She further stated that he was provided with only one adult diaper per day, which led to a severe deterioration in his condition to the point that he lost control over his vital bodily functions. The family also reported that prison authorities refused to accept additional diapers that the family attempted to provide, despite being fully aware of the worsening of his condition.
